JOHN Macleod has fallen into a trap (May 5). America's Founding Fathers specified the fundamental human rights to ''life, liberty, and the pursuit of happiness'' in the Declaration of Independence, not the Constitution.

The Declaration was issued in 1776. The Constitution, which sets out the law of the United States, was framed in 1787 and, after ratification, operated from 1789, when George Washington took office as the first President.

As John Macleod will recall, the drawing-up of the Constitution involved compromise and it permitted slavery, which was not abolished until the passing of the 13th Amendment in 1865.
